The undersigned principal(s) certify that he/she has full authority to act on behalf of the above-named account ("Applicant") and that all information contained in this application and on each document submitted in connection herewith is true and complete. The Applicant and each undersigned guarantor authorize ERXD LLC ("ERXD") to obtain credit profile information from the national credit bureau(s) for the purpose of considering this credit application and any subsequent update, renewal, collection or additional credit, and authorize each bank and trade reference listed to release information to ERXD. If this application for business credit is denied, you have the right to request a written statement of the specific reasons by mail to ERXD at 63 Montgomery Ave, Staten Island NY 10301 within sixty (60) days of notice; ERXD will respond within thirty (30) days. The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants; the administering agency is the Federal Reserve Consumer Help Center, P.O. For value received and to induce ERXD to extend credit to Applicant (as defined above), the undersigned Guarantor irrevocably and unconditionally guarantees the prompt payment and performance of all present and future obligations of Applicant to ERXD (the "Guaranteed Obligations"), up to the Maximum Credit stated above. This is a guaranty of payment and not merely of collection. Guarantor agrees that ERXD may require immediate payment from Guarantor without first pursuing Applicant or any collateral. Guarantor further agrees to pay all reasonable costs of collection and enforcement, including attorneys' fees. By signing below, Guarantor hereby waives: (a) notice of acceptance of this guaranty, credit extensions, renewals or modifications; (b) presentment, demand, protest, and all other notices; (c) any defenses based on the enforceability of Applicant's obligations or the impairment or release of collateral; and (d) all rights of subrogation, reimbursement, or contribution until all Guaranteed Obligations are fully paid. This guaranty is continuing, remains in effect until revoked in writing as to future credit only, and shall become immediately due if Guarantor or Applicant becomes insolvent or files for bankruptcy. The records of ERXD shall be prima facie evidence of the amounts owed. No amendment or waiver is effective unless in a signed writing by ERXD. This Continuing Guaranty is binding upon Guarantor, and his/her heirs, executors, successors and assigns and shall benefit ERXD and ERXD's successors, endorsees, transferees and assigns. All references to ERXD and Guarantor herein shall include their respective successors and assigns. The undersigned Guarantor acknowledges and agrees that the prevailing party in any proceeding to enforce this Guaranty or to resolve any dispute hereunder will be entitled to recover its costs of enforcement and collection, including without limitation attorneys' fees and collection agency fees from the other party.

If a payment cannot be processed, I agree to arrange alternate payment and to cover any resulting processing fees. Payment terms: On Shipping (no credit card fee); Net 30 (3% fee if paid by credit card); 10th of each month (3% fee if paid by credit card). I have read and agree to the terms above.
